1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and 23 Challenge ("we", "us", or "our"), governing your access to and use of the 23 Challenge mobile application, website, and related services (collectively, the "Service").

By creating an account, downloading, accessing, or using the Service, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue using our Service immediately.

2. Health, Fitness & Medical Disclaimer

The challenges, workout targets, streaks, and curriculum content provided in the Service are designed solely for general educational and motivational purposes.

• Consult a Physician: Always consult your physician or qualified healthcare provider before beginning any new physical exercise routine, endurance challenge, dietary shift, or sobriety/abstinence regimen, especially if you have pre-existing medical conditions, chronic illnesses, or injuries.
• Assumption of Risk: You voluntarily choose to undertake challenges and workouts presented within the app. You expressly assume all risks of personal injury, illness, or harm arising from your participation in any challenge.
• Listen to Your Body: Stop exercising immediately if you feel faint, dizzy, nauseous, or experience pain or discomfort. Never disregard professional medical advice because of information viewed in the app.

3. Eligibility and Account Registration

To use 23 Challenge, you must be at least 13 years of age (or 16 years of age in the European Economic Area). By registering, you represent and warrant that you meet this requirement and possess the legal capacity to enter into these Terms.

• Account Information: You agree to provide accurate, current, and complete information during registration and keep your account details up to date.
• Account Security: You are responsible for safeguarding your password and account credentials. You must notify us immediately of any unauthorized use or breach of your account.
• One Account Per User: You may not create multiple accounts for abusive, fraudulent, or deceptive purposes.

4. Acceptable Use and User Conduct

You agree not to use the Service for any unlawful or prohibited purpose. Specifically, you agree NOT to:

• Harass, abuse, defame, threaten, or intimidate other users, coaches, or team members.
• Upload or transmit offensive, fraudulent, harmful, pornographic, or violent images or comments as proof submissions.
• Interfere with, disrupt, or compromise the integrity or security of the Service, servers, or networks.
• Attempt to decompile, reverse engineer, or extract source code from the mobile applications or website.
• Use automated scripts, bots, scrapers, or exploits to generate fake check-ins or manipulate streaks.
• Share or distribute organization invite codes without proper authorization.

5. Subscriptions, In-App Purchases, and Billing

23 Challenge offers both free features and optional premium subscriptions ("Pro" or "Coach" tiers) unlocking extended challenge libraries, custom coach creation tools, and advanced analytics.

• App Store Billing: All in-app subscriptions and purchases on mobile devices are processed securely through the Google Play Store (for Android) or Apple App Store (for iOS) via RevenueCat. Your billing relationship is governed by the respective store's terms.
• Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
• Managing & Cancelling Subscriptions: You can manage or cancel your subscription at any time through your Google Play Store Account Settings or Apple ID Subscriptions settings. Uninstalling the app does not automatically cancel your active subscription.
• Refunds: Refund requests are handled directly by Google Play or Apple in accordance with their respective refund policies. 23 Challenge does not process direct payments or credit card charges.

6. Intellectual Property Rights

Our Content: The 23 Challenge name, logo, software code, user interface designs, curriculum texts, challenge structures, and visual assets are the exclusive intellectual property of 23 Challenge and protected by copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without prior written consent.

User Content: You retain ownership of any text reflections, check-in notes, or proof photos that you submit through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display that content solely as necessary to operate the Service and display your progress to you and your authorized team/organization members.

7. Account Termination and Data Deletion

You may terminate your account at any time directly within the app (Profile → Delete Account) or through our Web Deletion Portal. Upon deletion, your personal data and streaks are permanently removed.

We reserve the right to suspend, disable, or terminate your access to the Service at our sole discretion, without prior notice, if you breach these Terms, engage in fraud, or create liability for the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, NOR DO WE GUARANTEE ANY SPECIFIC FITNESS, HEALTH, PRODUCTIVITY, OR PERSONAL HABIT OUTCOMES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 23 CHALLENGE, ITS FOUNDERS, OFFICERS, EMPLOYEES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, LOSS OF PROFITS, DATA LOSS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When modifications are made, we will update the "Last Updated" date. Your continued use of the Service following the posting of revised Terms confirms your acceptance of the changes.
